Happy Bird Academy Privacy Policy — SMS / Mobile Messaging Addendum

This Privacy Policy Addendum describes how Happy Bird Academy (“we,” “us,” “our”) handles mobile phone numbers, SMS / text messaging, and related consent / data-sharing practices. This Addendum supplements (and should be read together with) our general Privacy Policy, and is designed to comply with A2P 10DLC / carrier messaging policies.

1. Purpose & Scope

  • We may send SMS / text messages to mobile phone numbers you provide, for purposes such as program updates, alerts, reminders, notifications, or promotional offers (if you opt in).

  • These messages are sent using third-party messaging providers (e.g. Twilio) and via 10-digit long codes (10DLC) where applicable, in compliance with carrier requirements (A2P 10DLC).

2. Consent / Opt-In

  • We will not send SMS / text messages to you unless you expressly opt in to receive them.

  • Opt-in may be collected through one or more methods (e.g. via web form, paper form, in-person, QR code, or via text keyword), provided the method includes clear and conspicuous language about message use, disclosures, and an ability to opt out. (As required under A2P 10DLC standards.)

  • On any web or app form where you enter your mobile number, we will include an unchecked checkbox (or similar control) where you affirm your desire to receive messages. The checkbox cannot be pre-checked. FG Funnels Help+2

  • The opt-in text or wording will include:
    • That by submitting your mobile number, you authorize us to send you SMS / text messages
    • That message and data rates may apply
    • That consent is not a condition of any purchase (unless legally required)
    • A link to this Privacy Policy / Addendum

3. Message Content & Identification

  • All messages we send will clearly identify that they are from “Happy Bird Academy” (or another recognizable name associated with us)

  • Messages may include links, but we will clearly disclose use of links in the campaign metadata

  • Sample message(s) will include opt-out instructions (e.g. “Reply STOP to unsubscribe”) and may include “HELP” instructions (e.g. “Reply HELP for support”) 

4. Opt-Out / Revocation of Consent

  • You may opt out of receiving future SMS / text messages at any time by replying STOP, UNSUBSCRIBE, CANCEL, or another permitted keyword. These keywords are case-insensitive and recognized regardless of punctuation. 

  • Upon receipt of an opt-out request, we will promptly (as reasonably possible) stop sending further messages to that number (except for a final confirmation message acknowledging the opt-out). 

  • We may also provide alternative means to unsubscribe, such as via email or web interface, and those instructions will be included in our messages or in policy references.

5. Data Use & Sharing

  • We use your mobile number only for the purposes you have authorized (e.g. notifications, reminders, promotional content if opted in).

  • We will not share or sell your mobile phone number to third parties or affiliates for marketing or promotional purposes. This is a requirement under A2P 10DLC policies. Alive5+3

  • However, we may share your mobile number (or associated opt-in status) with third-party service providers, contractors, or vendors only to the extent necessary to support the messaging service (e.g. our SMS vendor, analytics or delivery services).

  • In the event of a merger, sale, or legal obligation, data transfer may occur, but we will notify you where required by law.

6. Data Retention and Security

  • We retain mobile phone numbers and messaging consent/opt-out history for as long as needed to support the messaging relationships, to comply with applicable laws, or for legitimate business purposes.

  • We implement reasonable technical, administrative, and organizational measures to protect your data from unauthorized access, use, or disclosure.

  • Data is stored in [specify region / system] and access is limited to personnel or vendors with a “need to know.”

7. Your Rights & Choices

  • You may review, correct, update, or delete your mobile number or your consent preferences via [your account settings / contact us].

  • If you withdraw your consent, we will stop non-essential messaging (except messages necessary for service/account operations).

  • You may contact us at [email address / contact method] for assistance, or to request restrictions on processing.

8. Changes to Policy

We may update this SMS Addendum from time to time. When we do, we will post the revised version with a new “Last Updated” date. Your continued use of SMS messaging after the changes constitutes your acceptance.
